The firm provides its clients with a range of legal services that begin with forming optimal planning programs for land, taking into account outline plans applicable to the land; through supporting detailed planning in all stages of the relevant planning committees; arranging rights and managing relations with the various authorities – the different planning committees, government offices and bodies, local authorities and more.

Over the years, the firm has even specialized in the land sector managed by the Israel Land Authority, arranging financing support for developing and building projects that have received planning approval, obligations for developers/contractors in deals uniquely tailored for clients, taking into account planning, timetables, market conditions, taxation considerations, and other factors relevant for forming the deal and implementing it in the best possible way. The firm supports its clients in all stages of implementing transactions with developers – putting up appropriate guarantees, quality of construction, timetables, conducting sale or leasing deals of the properties that are built; and ultimately the process of registering the rights in the Israel Land Registry. All this, while being very careful regarding the quality of service and keeping to the terms laid out in the contractual agreement.

Over the years, the firm has handled the activities of dozens of landowners, contractors, developers and tenants including in such areas as urban renewal, and a range of broad-scope transactions such as combinations deals, in kind or in exchange, ordering construction services, sales transactions and partnership transactions.

Representing Landowners

For more than 30 years, Adv. Gideon Hatuka has gained major knowhow and experience in representing landowners requiring enhancement of their assets in order to realize the potential contained in them in the most optimal manner.

Today, with an excellent legal team, the firm supports landowners from analysis of the potential to improving the land’s value and planning through to the registration stage; organizing the planning team, architects, consultants and appraisers; building initial planning programs; supporting planning procedures from preparing plans through to approval of the plan; contracting with developers/contractors in appropriate agreements (combination in kind/exchange, construction services, partnerships etc.); handling required arrangements with the local authorities for development and construction according to the plans; handling the issue of land improvement levies and development expenses; supporting procedures for the issue of building permits; arranging financing support; drafting sales, leasing and partnership agreements; registering jointly-owned housing and registering rights for purchasers of apartments.

Representing Moshavim (Cooperative Agricultural Villages), Kibbutzim and Individuals

One of the core practice areas of the firm is representing tenants of leased land, (Moshavim, Cooperative Agricultural Villages, Kibbutzim and individuals) who come before the Israel Land Authority.

As part of this work, the firm supports those who lease land, from demanding their full rights according to leasing contracts or the plot of land, or arranging their rights with the Israel Land Authority including the rezoning of the land. All this is accomplished by the firm’s team, which is familiar with the latest decisions by the Council and Management of the Israel Land Authority. The firm has, for many years, represented and continues to represent Moshavim and Kibbutzim who come before the authorities in order to protect and realize their rights as empowered in historic contracts signed before the establishment of the State of Israel and which grants them unique and full land leasing rights in the standard leasing contracts issued by the Israel Land Authority.

Rezoning

As part of the range of services provided to the firm’s clients, the legal team, led by Adv. Gideon Hatuka, advises and represents landowners in complex procedures to improve the value and rezone the land, both for private landowners and those leasing from the State.

Over the years, Adv. Gideon Hatuka has handled the rezoning of thousands of acres of land throughout Israel. In some cases, agricultural land was rezoned for residential, commercial, office and factory construction, and in other cases the rights of the land in terms of value were enhanced, in cases where the planning did not realize the optimal potential.

Income-Producing Property

The firm specializes in handling and enhancing the value of all aspects of income-producing real estate and over the years has applied its expertise to the sector in a broad spectrum of projects.

Within this framework, the firm has supported the construction of successful centers for a range of aims and uses including; logistics, commerce, offices and factories located in a range of central points around Israel. In these cases, the firm advises rights holders on land, arranges land rights, pre-planning, the planning itself, negotiates with developers/contractors as well as construction agreements, sales and leasing agreements to end users.
